how to use the harpoon above water?

hi guys,

ive played C2 online with david (the one with the green posts

)
and i noticed that he can shoot with the harpoon above water. i cant. i dont know why and ive already tried the hot key (L) but i just cant let it work. anyone knows how to solve this?
